During the real estate downturn of the late 1980s and early 1990s, David devoted a significant amount of his practice to distressed commercial real estate loan workouts and foreclosures, representing primarily banks and savings and loans, both outside and in receivership or conservatorship. This experience helped to propel David as a frequent author and speaker in Texas on workout and foreclosure topics. In the latest, ongoing downturn, David has represented a number of special servicers (and fewer borrowers) in the handling of distressed commercial real estate loans, including real estate foreclosures and the issues and practices that are unique to or prevalent with CMBS loans in default.
