Another significant aspect of the effect of the latest economic downturn on commercial real estate is the resulting market for sales of distressed commercial real estate loans. Viewed as similar in many respects to a sale or purchase of the underlying real estate collateral, but with complexities around the fact that the lender/seller doesn’t own the underlying collateral, David takes special care on behalf of a prospective purchaser to not only conduct appropriate due diligence on the underlying collateral but also to thoroughly review and assess the loan documents that establish and govern the rights that are actually being purchased. On the seller side, David focuses on minimizing going-forward liability arising out of the proposed sale of the loan in exchange for what is almost certainly a discounted return on the loan asset.
